The directive was issued by the State Attorney-General and Commissioner for Justice, Dr. Olukayode Ajulo, as part of efforts to ensure legal compliance, transparency and neutrality in the public service ahead of the polls. 

According to the advisory, political appointees seeking elective offices are expected to resign on or before Tuesday, March 31, 2026, to enable them participate fully in party primaries and nomination processes in line with the Electoral Act 2026. Those affected include commissioners, special advisers, senior special assistants, directors-general, board chairmen and members of government agencies. 

The government also explained that career civil servants and other public officers are constitutionally required to resign, withdraw or retire from service at least 30 days before the date of election if they intend to contest. It said the requirement is backed by Sections 66(1)(f), 107(1)(f), 137(1)(g) and 182(1)(g) of the 1999 Constitution, as amended. 

Ajulo noted that while civil servants may still take part in preliminary political activities such as obtaining nomination forms and contesting party primaries, their resignation must take effect not later than 30 days before the relevant election date fixed by the Independent National Electoral Commission, INEC. He warned that failure to comply could result in disqualification. 

The advisory further directed heads of Ministries, Departments and Agencies to give the directive wide publicity and report compliance to the Office of the Secretary to the State Government, while warning that partisan political activity by serving public officers may violate public service rules and attract sanctions.
