The Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit against the Federal Government at the ECOWAS Community Court of Justice over alleged diversion, irregular expenditure, and failure to account for more than ₦78.8 billion allocated to social protection and cash-transfer programmes across Nigeria.
The lawsuit, numbered ECW/CCJ/APP/42/26, follows findings contained in the Auditor-General of the Federation's 2024 Annual Report, published on August 7, 2026. The report raised concerns about financial transactions involving the Ministry of Humanitarian Affairs and Poverty Reduction, the National Cash Transfer Office (NCTO), and the National Social Safety Nets Coordinating Office (NASSCO).
According to SERAP, approximately ₦33.751 billion reportedly transferred to more than 3.2 million households across 35 states in 2023 lacked adequate supporting documentation for verification. The audit also questioned ₦36.744 billion in payments reportedly made without prepayment audits and ₦4.616 billion in unsupported expenditure, alongside other financial irregularities.
SERAP is asking the ECOWAS Court to compel the government to provide a detailed account of the questioned funds, conduct an independent investigation, and recover any money established to have been improperly spent or diverted. The organization argues that failures in managing funds intended for vulnerable households could undermine Nigerians' rights to social security and an adequate standard of living.
The group also wants stronger financial oversight, transparent beneficiary verification, and accountability measures to prevent similar irregularities. SERAP maintained that its earlier request for government action had not received an adequate response. As of October 25, 2026, no hearing date had been announced for the lawsuit.
